Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the YourSender service (the “Service”) provided by Pageey.com Jakub Rozanski, a sole proprietorship registered in Poland at Piłsudskiego 19/9, 62-028 Koziegłowy (“YourSender”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
YourSender is a software-as-a-service platform that automates digital product delivery. You connect a store on a supported platform (currently WooCommerce, eBay, Etsy), upload digital products, and YourSender sends a delivery email to the buyer when a paid order is detected.
2. Eligibility and account
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for keeping your password and API keys confidential, and for all activity that occurs under your account.
You must verify your email address before some features will work. You are responsible for ensuring you have the right to connect each store you connect.
3. Plans, tokens, and billing
The Service is offered on tiered plans (Free, Starter, Pro, Business). Each plan includes a monthly token allocation; one token is consumed per successful delivery email. Plans, prices, and token allocations are listed at yoursender.org/#pricing.
- Subscriptions are billed in advance through Stripe. By subscribing you authorise us (via Stripe) to charge your payment method on a recurring basis.
- Token allocations refresh at the start of each billing period. Unused tokens do not roll over unless we expressly state otherwise.
- Prices are exclusive of applicable taxes (e.g. VAT, sales tax) which will be added at the rate determined by your billing location.
- You can cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not provide refunds for partial periods unless required by law.
- We may change prices on at least 30 days' notice. If you do not accept a price change you may cancel before it takes effect.
4. Acceptable use
You must not use the Service to:
- Distribute content you do not have the right to distribute (including pirated software, copyrighted works without licence, or trade secrets).
- Distribute malware, illegal content, content that exploits minors, or content that violates the laws of your jurisdiction or the buyer's.
- Send unsolicited bulk email, transactional or otherwise, that is not tied to a real order.
- Reverse-engineer, scrape, or systematically extract data from the Service beyond what the public API expressly permits.
- Circumvent rate limits, plan token allocations, billing, or authentication.
- Use the Service in a way that violates the terms of any connected platform (WooCommerce, eBay, Etsy, payment processors, email providers).
We may suspend or terminate your account, with or without prior notice, if we reasonably believe you are violating this section, the law, or the rights of others.
5. Your content and licence to us
You retain all ownership of digital products and other content you upload. You grant YourSender a limited, non-exclusive, royalty-free licence to host, store, transmit, and deliver that content as necessary to operate the Service on your behalf. This licence ends when you delete the content or close your account (subject to backups and the retention periods in our Privacy Policy).
You represent and warrant that you have all rights necessary to grant this licence and that your content does not infringe any third-party rights.
6. Connected platforms
The Service depends on third-party platforms (WooCommerce, eBay, Etsy, Stripe, Resend, etc.). We do not control those platforms; their availability, behaviour, and rate limits affect what we can do. If a connected platform changes its API or suspends our access, deliveries may be delayed or interrupted. We will use commercially reasonable efforts to restore service.
7. Service availability
We aim for high availability but do not guarantee uninterrupted operation. The Service is provided on an “as is” and “as available” basis. We may schedule maintenance windows and perform emergency maintenance with little or no notice.
8. Termination
You may terminate your account at any time from the dashboard. We may terminate or suspend your account on notice (or immediately for serious breach) if you violate these Terms, fail to pay, or use the Service in a way that exposes us to legal liability. On termination, we will retain data only as described in our Privacy Policy, then delete it.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free, secure, or uninterrupted.
We do not warrant that any specific buyer email will be delivered or opened. Email deliverability depends on factors outside our control (recipient mailbox provider, sender reputation, content of your template).
10. Limitation of liability
To the maximum extent permitted by law, YourSender, its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service, whether based on contract, tort (including negligence), or any other legal theory.
Our total aggregate liability arising out of or related to the Service, in any twelve-month period, is limited to the greater of (a) the fees you paid us in that period, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g. liability for fraud, gross negligence, or for consumer rights that cannot be waived).
11. Indemnity
You will defend, indemnify, and hold harmless YourSender from any third-party claim arising out of (a) content you uploaded or transmitted via the Service, (b) your violation of these Terms or the law, or (c) your infringement of any third-party right (including IP rights and platform terms).
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email to active merchants and posted on this page with a new “Last updated” date. Changes take effect 30 days after posting (or immediately for changes required by law). If you do not agree to the changes you must stop using the Service before they take effect.
13. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the courts competent for the seat of the operator in Poznań, Poland, and you consent to personal jurisdiction there. Where you reside in a jurisdiction that grants you the right to bring proceedings in your local courts (e.g. consumer protection laws), nothing in this section overrides that right.
14. Miscellaneous
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and YourSender concerning the Service.
- If any provision is held unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver of our right to enforce it later.
- You may not assign these Terms without our written consent. We may assign them freely (e.g. in connection with a merger or sale of the business).
